Sexual Violence Policy

(a)Ai?? Career College Group is committed to providing its students with an educational environment free from sexual violence and treating its students who report incidents of sexual violence with dignity and respect.

(b)Ai?? Career College Group has adopted this Sexual Violence Policy, which defines sexual violence andAi?? outlinesAi?? itsAi?? training,Ai?? reporting,Ai?? investigativeAi?? andAi?? disciplinaryAi?? responsesAi?? to complaintsAi?? ofAi?? sexualAi?? violenceAi?? madeAi?? byAi?? itsAi?? studentsAi?? thatAi?? haveAi?? occurredAi?? onAi?? its campus, or at one of its events and involve its students.

(c)Ai?? TheAi?? personAi?? accusedAi?? ofAi?? engagingAi?? inAi?? sexualAi?? violenceAi?? willAi?? beAi?? referredAi?? toAi?? asAi?? the ai???Respondentai??? and the person making the allegation as the ai???Complainantai???.

  1. Definition of Sexual Violence

SexualAi?? violenceAi?? meansAi?? anyAi?? sexualAi?? actAi?? orAi?? actAi?? targetingAi?? aAi?? personai??i??sAi?? sexuality, gender identity or gender expression, whether the act is physical or psychological inAi?? nature,Ai?? thatAi?? isAi?? committed,Ai?? threatenedAi?? orAi?? attemptedAi?? againstAi?? aAi?? personAi?? without the personai??i??s consent, and includes sexual assault, sexual harassment, stalking, indecent exposure, voyeurism and sexual exploitation.

  1. Training, Reporting and Responding to Sexual Violence

(a)Ai?? Career College Group shall include a copy of the Sexual Violence Policy in every contract made between it and its students, and provide a copy of the Sexual Violence Policy to career college management (corporate directors, controlling shareholders, owners,Ai?? partners,Ai?? otherAi?? personsAi?? whoAi?? manageAi?? orAi?? directAi?? theAi?? careerAi?? collegeai??i??s affairs, and their agents), instructors, staff, other employees and contractors and trainAi?? themAi?? aboutAi?? theAi?? policyAi?? andAi?? itsAi?? processesAi?? ofAi?? reporting,Ai?? investigatingAi?? and responding to complaints of sexual violence involving its students. *Any company participatingAi?? inAi?? offeringAi?? studentAi?? internshipsAi?? onAi?? theirAi?? premisesAi?? mustAi?? provideAi?? an undertakingAi?? inAi?? writingAi?? thatAi?? itAi?? isAi?? inAi?? complianceAi?? withAi?? allAi?? applicableAi?? legislation, includingAi?? theAi?? OntarioAi?? HumanAi?? RightsAi?? CodeAi?? andAi?? theAi?? OccupationalAi?? HealthAi?? and SafetyAi?? ActAi?? andAi?? willAi?? provideAi?? studentsAi?? accessAi?? toAi?? thoseAi?? policiesAi?? shouldAi?? they encounter issues relating to sexual violence in the workplace.

(b)Ai?? The Sexual Violence Policy shall be published on its website: www.careercollegegroup.com

(c) Career college management, instructors, staff, other employees and contractors ofAi?? Career College GroupAi?? willAi?? reportAi?? incidentsAi?? ofAi?? orAi?? complaintsAi?? ofAi?? sexualAi?? violenceAi?? toAi?? the VP Operations Ai??upon becoming aware of them.

(d)Ai?? StudentsAi?? whoAi?? haveAi?? beenAi?? affectedAi?? byAi?? sexualAi?? violenceAi?? orAi?? whoAi?? needAi?? information about support services should contact the Campus Director or VP Operations.

(e)Ai?? SubjectAi?? toAi?? SectionAi?? 4Ai?? below,Ai?? toAi?? theAi?? extentAi?? itAi?? isAi?? possible,Ai?? Career College GroupAi?? willAi?? attemptAi?? to keep all personal information of persons involved in the investigation confidential except in those circumstancesAi?? where itAi?? believesAi?? an individual is at imminent risk of self-harm, or of harming another, or there are reasonable grounds to believe that others on its campus or the broader community are at risk. This will be done by:

(i)Ai?? ensuring that all complaints/reports and information gathered as a result of the complaint/reports will be only available to those who need to know forAi?? purposesAi?? ofAi?? investigation,Ai?? implementingAi??Ai?? safetyAi?? measuresAi?? andAi?? other circumstances that arise from any given case; and

(ii)Ai?? ensuring that the documentation is kept in a separate file from that of the Complainant/student or the Respondent.

(f)Ai?? Career College GroupAi?? recognizesAi?? theAi?? rightAi?? ofAi?? theAi?? ComplainantAi?? notAi?? toAi?? reportAi?? anAi?? incidentAi?? ofAi?? or make a complaint about sexual violence or not request an investigation and not to participate in any investigation that may occur.

(g)Ai?? Notwithstanding (f), in certain circumstances, Career College Group may be required by law or its internal policies to initiate an internal investigation and/or inform police without the complainantai??i??s consent if it believes the safety of members of its campus or the broader community is at risk.

(h)Ai?? InAi?? allAi?? cases,Ai?? includingAi?? (f)Ai?? above,Ai?? Career College GroupAi?? willAi?? appropriatelyAi?? accommodateAi?? the needsAi?? ofAi?? itsAi?? studentsAi?? whoAi?? areAi?? affectedAi?? byAi?? sexualAi?? violence.Ai?? Students seeking accommodation should contact the VP Operations.

In this regard, Career College Group will assist students who have experienced sexual violence inAi?? obtainingAi?? counsellingAi?? andAi?? medicalAi?? care,Ai?? andAi?? provideAi?? themAi?? withAi?? information about sexual violence supports and services available in the community as set outAi?? inAi?? AppendixAi?? 1Ai?? attachedAi?? hereto.Ai?? Students are not required to file a formal complaint in order to access supports and services.

  1. Investigating Reports of Sexual Violence

(a)Ai?? UnderAi?? thisAi?? SexualAi?? ViolenceAi?? Policy,Ai?? anyAi?? studentAi?? ofAi?? Career College GroupAi?? collegeAi?? mayAi?? fileAi?? a reportAi?? ofAi?? anAi?? incidentAi?? orAi?? aAi?? complaintAi?? toAi?? the VP OperationsAi?? inAi?? writing.Ai?? TheAi?? other officials,Ai?? officesAi?? orAi?? departmentsAi?? thatAi?? willAi?? beAi?? involvedAi?? inAi?? theAi?? investigationAi?? are Director of Education/ Campus Director.

(b)Ai?? Upon receipt of a report of an incident or a complaint of alleged sexual violence being made, the VP Operations will respond promptly and:

(i)Ai?? determineAi?? whetherAi?? anAi?? investigationAi?? shouldAi?? proceedAi?? andAi?? ifAi?? the Complainant wishes to participate in an investigation;

(ii)Ai?? determineAi?? whoAi?? shouldAi?? conductAi?? theAi?? investigationAi?? havingAi?? regardAi?? toAi?? the seriousness of the allegation and the parties involved;

(iii)Ai?? determineAi?? whetherAi?? theAi?? incidentAi?? shouldAi?? beAi?? referredAi?? immediatelyAi?? toAi?? the police; InAi?? suchAi?? casesAi?? orAi?? whereAi?? civilAi?? proceedingsAi?? areAi?? commencedAi?? inAi?? respectAi?? of allegations of sexual violence, Career College Group may conduct its own independent investigation and make its own determination in accordance with its own policies and procedures; and

(iv)Ai?? determineAi?? whatAi?? interimAi?? measuresAi?? oughtAi?? toAi?? beAi?? putAi?? inAi?? placeAi?? pendingAi?? the investigationAi?? processAi?? suchAi?? asAi?? removalAi?? ofAi?? theAi?? RespondentAi?? orAi?? seeking alternate methods of providing necessary course studies.

(c)Ai?? Once an investigation is initiated, the following will occur:

(i)Ai?? The Complainant and the Respondent will be advised that they may ask another person to be present throughout the investigation;

(ii)Ai?? interviewing the Complainant to ensure a complete understanding of the allegation and gathering additional information that may not have been includedAi?? inAi?? theAi?? writtenAi?? complaintAi?? suchAi?? asAi?? theAi?? dateAi?? andAi?? timeAi?? ofAi?? the incident, the persons involved, the names of any person who witnessed the incident and a complete description of what occurred;

(iii)Ai?? informingAi?? andAi?? interviewingAi?? theAi?? RespondentAi?? ofAi?? theAi?? complaint,Ai?? providing detailsAi?? ofAi?? theAi?? allegationsAi?? andAi?? givingAi?? theAi?? RespondentAi?? anAi?? opportunityAi?? to respondAi?? toAi?? thoseAi?? allegationsAi?? andAi?? toAi?? provideAi?? anyAi?? witnessesAi?? the Respondent feels are essential to the investigation;

(iv)Ai?? Interviewing any person involved or who has, or may have, knowledge of the incident and any identified witnesses;

(v)Ai?? Providing reasonable updates to the Complainant andAi?? theAi?? Respondent about the status of the investigation; and

(vi)Ai?? Following the investigation, the VP Operations will:

(A)Ai?? Review all of the evidence collected during the investigation;

(B)Ai?? Determine whether sexual violence occurred; and if so

(C)Ai?? Determine what disciplinary action, if any, should be taken as set out in Section 5 below.

  1. Disciplinary Measures

(a)Ai?? If it is determined by Career College Group that the Respondent did engage in sexual violence, immediate disciplinary or corrective action will be taken. This may include:

(i)Ai?? disciplinaryAi?? actionAi?? upAi?? toAi?? andAi?? includingAi?? terminationAi?? ofAi?? employmentAi?? of instructors or staff; or

(ii)Ai?? Expulsion of a student; and /or

(iii)Ai?? The placement of certain restrictions on the Respondentai??i??s ability to access certain premises or facilities; and/or

(iv)Ai?? Any other actions that may be appropriate in the circumstances.

  1. Appeal

(a)Ai?? Should the Complainant or the Respondent not agree with the decision resulting from the investigation, he or she may appeal the decision to the President within 10 days by submittingAi?? aAi?? letterAi?? addressedAi?? toAi?? the President advising of the personai??i??s intent to appeal the decision.

  1. Making False Statements

(a)Ai?? It is a violation of thisAi?? Sexual ViolenceAi?? Policy for anyone to knowinglyAi?? make a falseAi?? complaintAi?? ofAi?? sexualAi?? violenceAi?? orAi?? toAi?? provideAi?? falseAi?? informationAi?? aboutAi?? a complaint.

(b)Ai?? Individuals who violate this Sexual Violence Policy are subject to disciplinary and / or corrective action up to and including termination of employment of instructors or staff or expulsion of a student.

  1. Reprisal

(a)Ai?? It is a violation of thisAi?? Sexual ViolenceAi?? Policy to retaliate or threaten to retaliate against a complainant who has brought forward a complaint of sexual violence, providedAi?? informationAi?? relatedAi?? toAi?? aAi?? complaint,Ai?? orAi?? otherwiseAi?? beenAi?? involvedAi?? inAi?? the complaint investigation process.

(b)Ai?? Individuals who violate the Sexual Violence Policy are subject to disciplinary and /or corrective action, up to and including termination of employment of instructors or staff or expulsion of a student.

  1. Review

(a)Ai?? Career College GroupAi?? shallAi?? ensureAi?? thatAi?? studentAi?? inputAi?? isAi?? consideredAi?? inAi?? theAi?? developmentAi?? ofAi?? its Sexual Violence Policy and every time it is reviewed or amended.

(b)Ai?? Career College Group shall review its Sexual Violence Policy 3 years after it is first implemented and amend it where appropriate. This date is December 1, 2019.

  1. Collection of Student Data

(a)Ai?? Career College GroupAi?? shallAi?? collectAi?? andAi?? beAi?? preparedAi?? toAi?? provideAi?? uponAi?? requestAi?? byAi?? the Superintendent of Private Career Colleges such data and information as required accordingAi?? toAi??
